Notary’s Quote for the Purchase of a First or Second Home and for the Mortgage
The notarial quote tool calculates, with an ordinary margin of approximation, the notary’s fees, the registration, mortgage and cadastral taxes, as well as stamp duties and the substitute tax on the mortgage, both when the deed is subject to VAT (in the case of a sale by a developer) and when it is not subject to VAT.
The quote provided—due to certain variables that may remain unspecified—is to be considered indicative and non-binding. For example, if a tax credit applies, it will be deducted in accordance with Law 448/1998, within the permitted limits. The cost of the deed is also estimated by considering a standard level of complexity.
The tool calculates fees and taxes both when the “first home” tax benefits apply and when no benefits apply, under ordinary taxation. The calculation also adapts to the nature of the deed, which may be subject to VAT or to proportional registration tax.
Here, the system computes both the taxes to be paid to the notary at the time of execution and those that will be part of the deed, such as the VAT payable to the seller when the sale is carried out by a developer. Conversely, the notary is the tax collector and is responsible for the registration, mortgage and cadastral taxes.
The taxes to be paid to the notary are only the registration, mortgage, cadastral, stamp and archive taxes. VAT on the purchase price, instead, is paid directly to the seller.
The substitute tax on the mortgage is withheld by the bank from the loan amount disbursed. This tax amounts to 0.25% in the case of a loan for the purchase of a first home and 2% for the purchase of a residential property that does not qualify as a first home.
